Elsa Saç Fırçaları operates this store and website, including all related information, content, features, tools, products and services (the “Services”), to provide customers with a carefully selected shopping experience. Elsa Saç Fırçaları is powered by Shopify, which enables us to provide the Services.

We do not warrant that the appearance or quality displayed will meet your expectations or be identical on every device. Product descriptions may change without notice at our sole discretion. We may discontinue products and limit quantities offered to any person, region or jurisdiction.

Placing an order is an offer to purchase. Elsa Saç Fırçaları may accept or reject an order for any reason at its discretion. An order is accepted only when we confirm acceptance and receive and process payment. Review your order before submitting it; after acceptance, cancellation may not be possible. If an order is rejected, changed or cancelled, we will try to contact you using the details supplied with the order.

Returns and exchanges are governed only by our Refund Policy. You represent that purchases are for personal or household use, not commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged is the price effective when the order is placed and shown in the confirmation email. Unless stated otherwise, advertised prices exclude taxes, shipping, handling, customs and import charges. Online prices may differ from prices in physical or third-party stores. Separate promotion terms prevail if they conflict with these Terms.

You agree to provide current, complete and accurate purchase, payment and account information and promptly update it. You represent that payment-card information is accurate, you are authorised to use the card, charges will be honoured, and you will pay all advertised charges, shipping, handling and applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

We are not responsible for shipping or delivery delays. Delivery times are estimates, not guarantees. We are not responsible for delays caused by carriers, customs or events beyond our control. Title and risk of loss pass to you when products are handed to the carrier.

The Services—including trademarks, brands, text, images, graphics, reviews, video and audio, and their design and arrangement—belong to Elsa Saç Fırçaları, its affiliates or licensors and are protected by applicable intellectual-property laws. We may provide access to third-party tools that we do not monitor, control or direct. Access is provided “as is” and “as available”, without warranties, representations, conditions or endorsement. We have no liability arising from optional third-party tools. Your use is at your own risk and discretion, and you must review the provider’s terms. New tools and features added later form part of the Services and are subject to these Terms.

The Services may include third-party materials, links or functions. We are not responsible for reviewing their content or accuracy. If you leave our Services to access them, you do so at your own risk. We are not liable for harm or loss arising from access to or purchase or use of third-party products, services, resources or content. SECTION 9 - RELATIONSHIP WITH SHOPIFY

Elsa Saç Fırçaları is powered by Shopify, but all sales and purchases in our store are made directly with Elsa Saç Fırçaları. By using the Services, you acknowledge that Shopify is not responsible for any aspect of a sale between you and Elsa Saç Fırçaları or for injury, damage or loss arising from purchased products or services. You expressly release Shopify and its affiliates from claims, damages and liabilities arising from transactions with Elsa Saç Fırçaları.

We may correct them, change or update information, or cancel orders at any time without notice, including after an order is submitted.

We may terminate this agreement or your access to all or part of the Services at any time without notice, at our sole discretion. You remain responsible for amounts due up to termination. Provisions on Intellectual Property, Feedback, Termination, Warranty Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy and provisions that by nature should survive will remain effective.

WE DO NOT WARRANT THAT USE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THESE MAY NOT APPLY TO YOU.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, ARET FIRÇA SANAYİ VE İTHALAT İHRACAT LTD. ŞTİ., OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL LOSS, INJURY OR CLAIM ARISING FROM USE OF THE SERVICES OR PRODUCTS, INCLUDING LOST PROFITS, REVENUE, SAVINGS OR DATA, REPLACEMENT COSTS, OR LOSS ARISING FROM ERRORS OR OMISSIONS IN CONTENT, EVEN IF ADVISED OF THE POSSIBILITY.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Aret Fırça Sanayi ve İthalat İhracat Ltd. Şti., Shopify and their affiliates, partners, directors, officers, employees, agents, contractors, licensors and service providers from third-party losses, damages, liabilities and claims, including reasonable legal fees, arising from your breach of these Terms or incorporated documents, violation of law or third-party rights, or access to and use of the Services. We will notify you of claims; delay does not release you unless it materially prejudices you. We may control the defence and settlement at your expense, but will not accept a settlement imposing non-monetary obligations on you without your consent, not to be unreasonably withheld. You agree to cooperate.

SECTION 19 - SEVERABILITY

If a competent court finds a provision unlawful, void or unenforceable, it remains enforceable to the fullest lawful extent and the unenforceable portion is severed. The remaining provisions are unaffected.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

Failure to exercise a right is not a waiver. These Terms and all policies or operating rules we publish concerning the Services form the entire agreement between you and us and replace prior or contemporaneous oral or written agreements, communications and proposals. Ambiguities will not be interpreted against the drafting party.

SECTION 21 - ASSIGNMENT

You may not assign or transfer this agreement or your rights or obligations without our prior written consent; attempts are void. We may assign or transfer these Terms and our rights and obligations without notice or consent.

SECTION 22 - GOVERNING LAW

These Terms and separate agreements for the Services are governed by and interpreted under the laws and courts of the jurisdiction in which Elsa Saç Fırçaları has its principal office. You and Elsa Saç Fırçaları submit to those courts’ jurisdiction and venue.

SECTION 23 - HEADINGS

Headings are for convenience only and do not limit or otherwise affect these Terms.

SECTION 24 - CHANGES TO TERMS

You may review the latest version of these Terms on this page. We may update, change or replace any part by publishing changes on our website. You are responsible for checking for changes. We will notify you of material changes as required by law; they take effect on the date stated in the notice. Continued use after publication constitutes acceptance.
